Very few of the pirates broadcast to other states, so it's not interstate 
commerce.  The law exempts pirates from other states broadcasting to 
Florida.  The state has a reasonable interest in the functioning of all 
civil emergency facilities, so they have every right.

Of course, your buddies in the American Criminal Liberties Union will work 
like hell to make sure that Osama's supporters can continue to broadcast on 
any channel with as much power as they want without a license.
