The text of the amendment doesn't restrict itself to government actions,
but neither does the so-called separation of church and state grant the government
the rights to make every law with respect to any religion, and prohibit the free
exercise thereof, either.
What the Constitution says means nothing, but how it's (mis)interpreted
means everything.
As such, I'm certain it would take a well-funded class action make-the-lawyers-rich-
while-punishing-everyone-else type of suit to get that straightened out, so more than
likely ( after years of litigation ) the "appropriate" settlement would be something
like a mail-in rebate coupon to anyone who can prove they suffered damage as a
result of the root kit limited to 10% of the actual costs of recovery, or $1.00 discount
on a single future purchase from Sony, whichever is the lesser of the two,
or perhaps a one-time payment to Micro$oft to defray their cost of providing
a cure in future upgrades, but nothing for existing systems.
Something like that.
