Section 73.1206 applies to both pre-recorded telephone conversations as well 
simultaneous or live broadcasts of conversations...

"Before recording a telephone conversation for broadcast, or broadcasting 
such a conversation simultaneously with its occurrence..."

The moral of the story is "ask first."
