And what was the response of the NY State PUC?  Did they take the telco to task
for not properly maintaining that equipment?

I may be very wrong here, but I don't see a stampede of hospitals, EOC's, or
first responders away from telco phone service.  It would seem that requiring
proper levels of maintenance should be a matter of high priority for the 
regulators.
