No no no. CC is going to dictate that all measurement be done with PPM or equal. So it'll be based on encoding. 

OH wait, that doesn't work in small markets. 

OH wait, small markets don't matter???? We certainly are not getting much say, be it ratings measurement methodology or HD. 

I do agree- HD1 and HD2 are it, we're stuck with that. For Ibiquity and The Dominion to come along at what amounts to the last hour and suggest they don't know how to market it, or that the intitial labeling is confusing --- well, they should have thought of that LONG ago.
