73.72(a) An AM station may operate during the experimental period
(the time between midnight and sunrise, local time) on its
assigned frequency and with its authorized power for the routine
testing and maintenance of its transmitting system, and for
conducting experimentation under an experimental authorization,
provided no interference is caused to other stations maintaining
a regular operating schedule within such period.
So, NO, you can't do it if it causes interference, and you can't
operate in a way that is not licensed one way or another.
Can a 50 kW operate non-DA during the EP if not licensed for non-DA
during the daytime? Not legally. If it is so licensed, it must
restrict operation to the minimum so as not to cause interference.
Back in the days of audio proofs, every station had to do it at
least once per year, and we did, but only with authorized day and
night facilities. The rule that required audio proofs required
testing of daytime power and pattern as I recall it.
In earlier versions of 73.72 I recall that program audio could be
transmitter only for the purpose of equipment adjustment. And, even
today, 73.72(b) says:
"No station licensed for daytime or specified hours of
operation may broadcast any regular or scheduled program
during this period."
What you may do LEGALLY is clear. The problem or not, depending on
your outlook, is that this gets about the same level of enforcement
as other technical rules these days.
