Not surprised. In my geneal there is an illegal LP FM station running, has been for years. Guy knows he is illegal, but makes his money, and the FCC never inspects since no station is even listed there!
And other stations I have visited keep scanty if any logs, and usually are operating overpower and with excessive modulation, especially in competitive situations. Operators carbon copy logs day after day. If they keep any logs.
The Hired "mock inspections" never find anything wrong, even if the paint is peeling in 6" strips off the tower.
With the FCC so remote and impotent these days, and nobody consistently enforcing the Rules, not surprised a few just throw the rules away and do that they want, and eventually get their hand slapped.
I have seen in bigger markets during ratings wars when everybody was running the FMs at 125% modulation. Didn't sound any worse than usual, just louder distortion. By the time canned CD music got thru several stages of processing, not much but distortion remained anyhow.
This is the "Evolution" of radio, as the great god FCC is realized to be impotent, for the most part. And in general basically uninterested.
