  Honestly, I cannot see why not but, I'll put it in the same words as
the response I got from an inspector to whom I had posed the very same
question:
 
  "It depends on whether or not anyone complains and how much
complaining is done. I can promise you that, after receiving enough
complaints, someone will become determined to find a violation and it
will happen. When that happens, will you really want to have the
programming of your commercial station on the part-15 transmitter so
that your commercial license could be lost as well?"

  Taken in THAT light, I decided to be happy with what I had... (I had
been considering a single part-15 in the center of several surrounding
cities - with NO local service - that would be programmed via 67khz.
SCA. These would've been "super-local signals" with such fair as
"Swap-Shop", etc.)
