[BC] Mom & Pop Stations endangered? KBKH-FM

Gentlemen: Keith & Paul....

I've had several conversations with Mr. David Rushing, as well,
and people like him and Amanda Baskin, do not understand that if you
don't have a FCC license, you have nothing. I've explained to these
people anybody can go buy a building, buy radio equipment (be it a
broadcast supplier, ebay, etc.) put up a tower and antenna, but you
don't have a radio station unless you have a FCC license.
James Turvaville (Jim Turbo), had every right to transfer the KRMN
license to Keith Hammond. The most current ownership report at that time
that the commission had on file, indicated that Turbo Radio Partners,
LTD, was the licensee and that Jim was the legal president. This holds
in tact, despite what Rushing claims is on file with the state of Texas
in Austin.
Amanda K. Baskin, who claims to be friends with David Rushing,
called me and said she would have me, Keith Hammond, Jim Turbo, Paul
Walker, and Powell Way shut down. This woman is nuts. I found she has no
knowledge of this industry, and FCC Laws.
She called my radio station, along in the back ground her gay
friends, Brian & Gregory, yelling in the background, says we all helped
Keith steal KRMN. I made it clear to her that I lost $3,500.00, because
her friend, Jody Richie, who stole equipment I sent to Keith for
repairs. I find it hard to believe that Ms. Baskin is defending Mr. Jody
Richie, and she claims to be a "drug and alcohol counselor" with a fake
B.S. degree from Western Kentucky University, and she is currently
working in a Nashville area hospital in this position. I also found out
that Mr. Rushing's sister lives in Murfresboro, TN. Because of this
ordeal, while I was on vacation in Punta Gorda, FL, a neighbor witness,
saw Ms. Baskin and her friend, Mr. Brian Micahels, slash my tires on my
car, parked in my driveway at my residence. We have no proof, but I
believe Jody Richie was with them as well in the middle of this, as
well.
Rushing and Baskin both claimed there was quite a few calls to my
business and home, during the time Keith was running KRMN in the winter
and spring of "02". Keith was assisting me in automation problems and
acting as a tech consultant at that time.
Keith didn't steal anything; he obtained the license in a legal
fashion. Rushing is just plan upset due to the assets once used for KRMN
can not be auction off to pay off the loan that the EDB owes the bank,
and they simply know they can't sell the assets as a radio station
without the license. I advised my Rushing that he needed to sell the
assets and his board just do the best it could to repay the balance of
the loan, after the assets were sold off.
Mr. Rushing and Ms. Baskin both called me, bragging when Keith was
"WRONGLY" arrested for stealing checks that was revue that belong to
KBKH. I still have a claim against the Shamrock Economic Development
Corporation for wrongly detaining assets that belong to my company, that
didn't belong to them.
Paul, you have done nothing wrong on your websites describing what
has happen to Keith, his family and the radio station. I had an attorney
look at one of you sites and he tells me you have done a good job,
keeping the content straight to the facts.
I've just about had enough of all of this, and the money that I
lost and it's time somebody pays me.
Keith, you have nothing to worry about, if Mr. Rushing fires up
that equipment, he is considered a pirate, and the commission will come
down on him hard, plus his informal objection will not hold up in the
license renewal. Despite any local (Wheeler County) or state law suits,
the local and state governments have no right to allow Mr. Rushing to
turn on that equipment and operate a radio station. Federal laws
overrule that.
Keith, like I said, and so has Jim, please shut the station down
and move it to Sare, OK. I realize it will put a strain on you and
Bessie, and the kids, but you will do better in the long run and be able
to live a peaceful life with your family and your station.

That is a most accurate assessment of the situation. His door to door
"investigation of radio advertisers" in which the (armed) county
constable appears as a "show of force" and asks who is spending how much
with the local radio station and then hands them the memo (on EDC
letterhead) advising that "all debts to the local radio station are
payable to Mr. David Rushing" are pretty darn convincing!

And extremely generous (IMHO) to boot! Neither you, nor I, nor the US
Government will EVER convince him otherwise. I was totally dumbfounded
when I watched both Mr. Rushing as well as the (former) DA who is now a
prison-cell occupant testify to a jury that the CERTIFIED copy of my
station license was "a known forgery" and the judge allowed the DA to
instruct the jury to IGNORE IT as "a known forgery".

What can you do when the people with whom you are dealing know more
about your field of expertise than you know, yourself?

Of course, their "expert witness" (filed A transfer application in
1979, according to his testimony) who testified that "a broadcast
license CAN NOT be transferred by filing an online application via
computer" didn't help any. But... He was the "expert"...

> Mr. Rushing actually threatened, on 2 or 3 ocassions, to sue me!

So, give him a reason! He's currently suing me for preventing his
operation of an (unlicensed and non-existent) FM station. The taxpayers
are footing the bill since he's a representative of a city government
so, I'm sure he would like to add you to the list. His suit against me
is asking for $250k PLUS the right to "put Mr. Rushing's KRMN back on
the air without interference from the new station that has seized his
spot on the dial without any authorization of the Great State of Texas"
or some such nonsense. (Honest! I *did* look for the "Texas
Communications Commission"! Really, I did!)

I'm sure he'd even like to go after Powell for that noxious cloud he
left behind following his last "burrito encounter". ;-)
