  Scott,

  I appreciate the thoughts and the help. Unfortunately, I had exhausted
all of my resources. The commission (rightfully) takes no interest in my
situation as they say, "We cannot do anything to Mr. Rushing because he
is not a licensee."

  The local prosecutors take no interest in the situation as they are
overly anxious to cover-up the "wrongs" of the former DA (the one who's
now serving time in the federal pen).

  I had (mistakenly) pinned my hopes on the appointing of an "honest"
district attorney and that is one of the reasons I did all that I could
to bring to light the drug dealing of the former DA. He has now
confessed to various drug and firearms violations and is serving a VERY
short sentence (the original sentence was supposed to have been "from 20
to 99 years" or some such).

  This is where it all went wrong: The governor of Texas, for whatever
reason, decided to promote his assistant instead of bringing in a new DA
from outside. His assistant gad already signed affidavits stating that
she was "aware of Mr. Roach's drug-related activities long before his
indictment" as well as having knowledge of his "performing political
favors in exchange for cooperation in his drug-related activities"
(prosecuting me, for Rushing, was one of those "favors"). She also has
signed affidavits stating that she had personally observed Roach as he
"injected methamphetamines into his penis to heighten his sexual
experiences". (I don't know why she'd be watching THAT but, when you're
in Texas, I guess you share everything!)

  Anyway, she was very quickly appointed as the new district attorney
over the protests of many and immediately set out on a mission to blame
the former guy with EVERYTHING while "disposing of" anyone who might
reveal her "closer than it should've been" association with the former
DA.

  I, my wife, our attorney, our attorney's wife and several others have
recently observed her walking, hand-in-hand with David Rushing so, it
looks like this matter will never see any form of "true justice".

  And, to think: I was stupid enough to think that showing the former DA
to have been engaged in felonious activities would be grounds for
opening an investigation into his "prosecutions as favors for fellow
criminals"? Not here! I helped get him brought to justice and, as a
"Thank You", they appointed his loyal assistant to prosecute (persecute)
me even more viciously than before out of spite?

  I'm posting some of the actual court transcripts to our website during
the next several days. I'll send you a link so that you can see where
Mr. Rushing (correctly) states on one page that I was "operating the
station in the name of the former licensee" on one page and then,
several pages later, he's ranting about how I had "stolen his
(Rushing's) license and was caught depositing checks to his (Rushing's)
radio station" into my account while "in our (Rushing's) employ".

  I'd like to see him show me (or anyone) a job application, tax
documentation, withholding statements, or some such... On second
thought... I'd just like for him to show me a license or an LMA
agreement so that he could legally claim to have "hired" me to operate
"his" station during the time I had the LMA and the transfer was
pending...

  The guy has an imagination! And, he has just enough friends in all the
wrong places to make it happen! Rushing and his friends are now holding
a "morning countdown" leading up to February 28th in the local coffee
shops and restaurants. What is February 28th? He (and the "replacement
crooked DA) claim that is the day they have "setup" as the date that ALL
of my appeals of this (so-called) "conviction" will be thrown out
because of "prior arrangements made with the courts". (They are actually
BRAGGING that they are "rigging" court cases!)

  He still issues (almost) monthly reminders in the local newspaper that
no one is allowed to do business with the radio station. Of course, the
federal government is not interested. Even the ACLU is not interested!
Not even in the case in which I spent 40 days locked in the Wheeler
County Jail and the newspaper proudly announced "The local radio station
owner was arrested and held under 'no bond' because he allowed opinions
to be expressed on his website and on KBKH 92.9-FM." ACLU tells me that
they are not interested because I am "not enough in the minority"...

  Bottom line: These people can and will do ANYTHING THEY WANT and no
one cares...

  I apologize for the long post but, this might give some of you an
ideal of just exactly what is possible when government goes wild.
