If you remove the top beacon you will be lowering
the tower height. If this is an AM tower, the base Z
will change if the wire and lighting choke are removed.
I successfully filed with the FAA and FCC to extinguish
lighting on a NCE station whose roof mounted tower
was dwarfed by a nearby unlit communications tower.
I reduced the OHAG by 3 feet by removing the top
beacon assembly.

My advice is to consult with your attorney.

Tom,
   I checked it out, no mention of tower lighting. Should I just turn
them off and leave them up there OR take the top beacon and side lights
down completely.
