Hypotheticly.......
Let's say I find a few million dollars, with nothing to do.
Let's say I build a tower.
Nice, little tower. 2000 feet, 8 inch solid legs, 3 inch guy wires.
Then I lease space to various TV and radio stations, public safety
( like police and fire ) and whoever.
The lights fail.
I don't report it. I got my rent, so why should I care ?
Who would I report it to ? HUD ? I'm a landlord, not a broadcaster !
Maybe I'll tell the fire department. They deal with hazards, don't they ?
Besides, I haven't made my bi-monthly visit yet. That's tomorrow.
Unless someone called me, I don't even know !
The licensee's don't report it. "Not my problem."
They have a lease provision that says that *I* will maintain the lights.
Of course, MY idea of maintenance is to check the lights once
a month, or so, maybe, probably. If they fail, I'll find it, eventually,
and then I'll start looking for someone to fix 'em, probably.
A commuter airline hits the tower.

I get John Edwards to represent me, and he claims that I'm
not responsible to any "controlling legal authority" so I'm not
liable, even though I clearly "broke the law" !
I'm a landlord, not a licensee !!
The licensee's ARE responsible to a "controlling legal authority"
but they have a lease provision, so they're not legally "liable" !
It's fairly well known that I'm no fan of govt. controlled health care,
outdoor smoking bans, or most of the infringements on freedom
we've seen in the last 40 years or so, but this is one where
they very clearly got it right !!
