The FCC often acts on whim and bias.  The Supreme Court, in most  
cases, need not take a case unless it is interested, and while they do  
read the newspapers, the record of other misfeasance and malfeasance  
by the Red Lion station would not impact on their decision here.   
Remember, too, that there was a separate appeal heard here of the  
constitutionality of the codified personal attack rule brought by the  
Radio and TV News Directors Association.  One interesting fact is that  
the RTNDA's case was argued before the Supreme Court by Archibald Cox.
