 I'm glad you asked that question.

 The scenario, as I understand it, is that the court of appeals for the
 District of Columbia exclusively, claimed jurisdiction over the entire
 USA, it's possessions and territories, having nothing whatever to do
 with, in, or near, or in any way affecting the District of Columbia.
 Typical of activist judges.
 OK so far ?
 Good.
 These bleeding hearts who seem to exist everywhere, and from no
 particular administration, have set a precedent of legislating from
 the bench, bypassing the legislature at almost every turn.
 Precedent, as we all know, means more than life itself, or any action
 of the legislature to the contrary, provided it supports this particular
 activist judges opinion and political leanings.
 Still with me ?
 Some bunch of bird brains filed a "law" suit in said activist court,
 usurping jurisdiction from anyone and everyone, probably from God
 himself, ( since liberal judges always know better ) alledging that the
 FCC has failed to sufficiently punish licensees for obviously and agrediously
 attempting to wipe out the entire bird population of the world with
 their EEEEVIL broadcast and cell phone towers.
 The court then ruled that the uneducated public *must* be given opportunity
 to express ill informed ( if informed at all ) opinions, *and* that these opinions
 be given weight far, far exceeding that of the real world experiences of
 anyone else, especially acknowledged experts in the field, since the opinions
 of the uneducated obviously are always more correct.
 The court then ordered the FCC to implement policy changes ( but not rule
 changes, since that would require public comment, and we can't have that ! )
 such as to require any member of the public to demand expensive and useless
 studies anytime anyone feels like they need some way to cost those EEEEVIL
 broadcasters and cell phone providers more money for no reason at all.

 As such, the FCC is <best WW2 TV german accent here> "merely following orders."

 Clear ?
 I didn't think so.
 Clearly, you need to down a few more gallons of eggnog, heavy on the bourbon.
 Then, it should all make perfect sense.
