I may be wrong, but I thought the Communications Act gave the DC Court 
of Appeals jurisdiction over appeals from orders of the FCC?

That said, I agree with your argument that the whole thing is absurd. 
While I was watching a contractor unload our new siding into my garage 
this afternoon, I watched two flights of Canadian geese headed south for 
the winter. They obviously missed the group of 4 2000' towers about 15 
miles north of here, with no need for the assistance of the humans who 
are allegedly trying to help them...
