Keith,
There were bad business decisions made here. Mr. Rushing has done all
he can to try to cover mistakes he has made with the deal between Jersey
Boy Media and his group. The EDB should not be "lending funds" to new
start up businesses. As I pointed out to Paul, the real property used
for KRMN should have sold off at auction to recoup the losses the EDB
lost. If I was the bank, that's what I would do. The license was NOT in
the inventory as a asset when the station was sold from Turbo Radio
Partners to Shamrock Broadcasting a.k.a...Jersey Boy Media. Mr. Rushing,
(and I told him this in a conversation I had with him) can not claim the
license. I
As Jim Turbo pointed out to you, as soon as the license was granted
to you, the station should have been taken dark "right then", and move
to Sare, OK. I would have stayed out of Wheeler County. Yes, we all
make mistakes, and we learn from those.
There was nothing illegal on the license transfer, being the license
was still in Turbo Partnership, LTD, and the commission still recognized
Jim as the President of the company, due to the last ownership report
that was filed by the commission. Rushing claimed that state records
held up, vs. the commissions ownership reports. I refered him to my FCC
Attorney to explain this to him. He didn't do this and followed advise
from a local attorney that was ignorant in FCC law.
IMHO....I would shut down the station in Shamrock, file to move it
across the state line, and operate it in Sare, OK. I, Jim and you
learned what happen with KBYP-AM in the 80's, and the same thing doesn't
need to happen to KBKH. I know it will put a strain on you and your
family, but this would be in the best interest for you.

I, too, agree with BOTH of you. But, you must also recall that the
acts you describe were made impossible when Mr. Rushing and his group
filed the $250,000 civil suit in which they allege that our operating of
the licensed station (KBKH) is "preventing the operation of Mr.
Rushing's KRMN". That civil suit was then shortly followed up by the
Criminal indictment in which the methamphetamine influenced DA (now in
the federal "motel" for the next five years) alleged that I have "stolen
from Mr. Rushing's radio station, known as KRMN".
Criminal indictments, by necessity, make move impossibility...
Now, if I could only get them to realize that a DA who's confessed to
selling dope *through* his courthouse office can be influenced by other
crooks with an evil agenda, we might get somewhere. Until then I fear
(as I did in the beginning) that remaining silent for as long as THIS
will require would exceed the maximum allowable 365 days by far...
Scott, you of all people should know how "determined" Mr. Rushing can
be. Do you recall how long it took us all (working together) to get the
remaining 30 watt LPB AM transmitter returned when he was insisting that
it was "instrumental in the operation of KRMN"?
But, I do agree that the loan should've been satisfied. That is why I
had offered to pay it out. I just did not know that he would empty the
station out of more than $40k (more than enough to cover the delinquent
amount left by the Jersey Boys) *and* demand the station - license
included - as collateral. He still cannot seem to comprehend that the
"boys" they loaned money to were not the licensees, let alone that a
broadcast license cannot be directly "collateralized". His logic is
that, they have taken a tower and a building and some equipment.
Therefore, they have a radio station that cannot be operated or sold
because the "new station" (KBKH) has "taken over by force" there "spot
on the dial".
