Sid,
What we have are individuals in local government in Wheeler County,
Texas that do not understand communications law. I have advised Keith he
must in this case, and I mean MUST, have a communications attorney
represent him and explain to Ms. Switzer (Local DA) what the Federal
Laws are, and how the FCC views this.
Ms. Switzer can not give authority to Mr. Rushing to operate that
equipment as a "legal" radio station. Her and Mr. Rushing would be
violation of federal laws and Ms. Switzer could be in danger of losing
her job, and or being fined as well.
Oh, by the way, if that was to happen, everyone on this list has the
right to complain and the nearest FCC field office should investigate.

Once he tries to operate a radio transmitter without a station license,
he becomes a pirate, and then you may rest assured that the Friendly
Cookie Company will take a very real interest in that particular
situation, especially if a licensee complains (hint, hint...).
