Robert, what you wrote is true, but it looks like you may have meant to 
say .... "and be a class D."

Just for the sake of accuracy, a Class D may have any power during
daytime (or critical hours AFAIK), but it MUST have less than 250 W
nighttime power, or it becomes a class B and must meet all class B
requirements. (See 73.21(a)(3).) This is a case where power is the
important consideration. (One of the few, it is true.)
