 That's occupied bandwidth, not modulation. There's a difference.

 You can have peaks of less than 1ms deviating 1 MHz ( the way
 I read the rules ) and be way out of occupied bandwidth, but still
 be well within modulation limits.
 This, of course, will cost the all important "loudness" on some
 types of monitors.

 On the other hand, you could be over-modulating, deviating 
 119 kHz and be within occupied bandwidth, but over modulating.
